This Privacy Policy explains how MOMENTFORGE, Inc. ("MOMENTFORGE," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit momentforge.com, contact us, or otherwise interact with this website.

1. Scope

This policy applies to personal information handled through this website and related communications. It does not govern information we process for a client under a separate agreement, information collected by a third-party website, or the privacy practices of a client, partner, or platform that we do not control.

2. Information we collect

Information you provide

When you contact us, request information, or submit an inquiry, we may collect your name, email address, company or organization, the services you are interested in, the contents of your message, and any other information you choose to provide.

Please do not send sensitive personal information, confidential client information, financial account details, government identifiers, health information, or other information that is not necessary for us to respond to your inquiry.

Information collected automatically

When you visit the website, our hosting, delivery, and security providers may automatically receive limited technical information such as your IP address, browser and device type, operating system, referring page, pages requested, approximate location derived from your IP address, timestamps, and diagnostic or security logs. When analytics and advertising technologies are enabled, we and our providers may also collect online identifiers, page views, clicks, navigation paths, campaign source, interactions with Site features, and conversion events. We do not use this website to collect precise GPS location.

Information from other sources

We may receive business contact information from a colleague who refers you, from public professional sources, or from a service provider acting on our behalf. We use that information only for legitimate business communications and as permitted by law.

3. How we use information

We may use personal information to:

  • respond to inquiries and communicate with you;
  • evaluate a potential project or business relationship;
  • operate, maintain, secure, troubleshoot, and improve the website;
  • measure website traffic, performance, campaigns, and conversions;
  • understand how visitors use the Site and which content is useful;
  • measure and improve advertising and, where permitted, deliver more relevant advertising;
  • protect our rights, users, systems, and business from fraud or misuse;
  • comply with law, legal process, and enforceable government requests; and
  • complete a merger, acquisition, financing, reorganization, or sale of assets.

Where a law requires a legal basis for processing, we rely on your consent, steps taken at your request before entering a contract, performance of a contract, compliance with legal obligations, or our legitimate interests in operating and protecting our business and communicating with prospective and existing clients.

4. Cookies and similar technologies

We and our service providers may use cookies, pixels, tags, local storage, and similar technologies. A tag-management system may be used to deploy and manage these technologies. They generally fall into the following categories:

  • Essential technologies support security, network delivery, accessibility, and core Site functionality.
  • Analytics technologies help us understand traffic, navigation, engagement, performance, and errors, generally using online identifiers and device or browser information.
  • Advertising technologies help measure campaigns and conversions, limit repeated ads, create or reach audiences, and deliver or assess more relevant advertising across websites or services.

Where required, nonessential analytics and advertising technologies will not be activated until you make a choice through our consent banner. You can revisit that choice through the privacy or cookie-preference control made available on the Site. You can also manage cookies through your browser settings, although blocking essential technologies may affect how the Site works. We configure our analytics and advertising tools not to intentionally receive the contents of contact-form fields or sensitive personal information.

5. How we disclose information

We may disclose the categories of information described above to:

  • hosting, infrastructure, security, email, communications, and other vendors that process information for us under appropriate restrictions;
  • analytics, tag-management, advertising, and social-media partners that help us measure Site use and campaigns or provide advertising services, subject to your choices and applicable law;
  • professional advisers such as attorneys, accountants, and insurers;
  • law enforcement, regulators, courts, or other parties when we reasonably believe disclosure is required by law or necessary to protect rights, safety, and security;
  • a buyer, investor, lender, or successor in connection with a proposed or completed corporate transaction; and
  • other parties when you direct us to disclose information or provide consent.

We do not authorize service providers to use personal information for their own unrelated marketing purposes.

6. Advertising and privacy choices

We do not sell personal information for money. When advertising pixels or similar technologies are enabled, however, we may disclose identifiers, device information, internet activity, campaign data, and conversion events to advertising or social-media partners. Some privacy laws define that disclosure as a "sale," "sharing," or processing for targeted advertising even when no money changes hands.

Where applicable, you may opt out through the Site's privacy or cookie-preference control or by contacting us as described in Section 9. We also honor legally recognized browser-based universal opt-out signals, such as Global Privacy Control, as requests to opt out of sale, sharing, or targeted advertising for the browser or device that sends the signal. We do not use Site data for profiling that produces legal or similarly significant effects, and we do not knowingly sell or share personal information of people under 18.

7. Data retention

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including responding to inquiries, maintaining appropriate business records, resolving disputes, enforcing agreements, meeting legal obligations, and protecting the website. Retention periods vary based on the nature of the information, the relationship, and applicable legal or operational requirements. We may retain de-identified or aggregated information that can no longer reasonably identify you.

8. Data security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No website, transmission, or storage system is completely secure, so we cannot guarantee absolute security. Please use care when deciding what information to send online.

9. Your privacy rights

Depending on where you live and subject to applicable exceptions, you may have the right to confirm whether we process your personal information and to request access, correction, deletion, or a portable copy. You may also have the right to withdraw consent, object to or restrict certain processing, opt out of sale, targeted advertising, or qualifying profiling, and receive equal service and pricing when exercising a privacy right.

We may need to verify your identity and authority before acting. An authorized agent may submit a request where permitted by law, but we may request proof of authorization.

If we decline a request, you may appeal by replying to our decision or emailing the same address with "Privacy Appeal" in the subject line. We will respond within the period required by applicable law. You may also contact the relevant state attorney general, privacy regulator, or data protection authority.

10. California privacy notice

This section supplements the policy for California residents. In the preceding 12 months, we may have collected the following categories of personal information: identifiers and contact information; internet or other electronic network activity; approximate geolocation derived from IP address; professional or employment-related information you choose to provide; and the contents of communications you send to us.

We collect those categories directly from you, automatically through the website and our service providers, and occasionally from referrals or public professional sources. We use and disclose them for the business purposes described in Sections 3 and 5. We may disclose these categories to service providers, analytics providers, advertising and social-media partners, professional advisers, transaction parties, and government or legal recipients as described above. We do not sell personal information for money. Depending on the technologies you permit, we may have "shared" identifiers, internet or network activity, approximate location, and campaign or conversion data with advertising and social-media partners for cross-context behavioral advertising. Those categories may have been shared for that purpose during the preceding 12 months. We do not knowingly collect or use sensitive personal information through this website for purposes that trigger a right to limit under California law.

California residents may have rights to know, access, correct, or delete personal information; receive a portable copy; opt out of sale or sharing; limit certain uses of sensitive personal information; and not be discriminated against for exercising a right. You may opt out of sale or sharing through the Site's privacy or cookie-preference control, through a recognized universal opt-out signal, or by using the instructions in Section 9.

11. Children's privacy

This website is intended for a general business audience and is not directed to children under 13. We do not knowingly collect personal information online from children under 13. If you believe a child has provided personal information to us, contact us so we can review and delete it as appropriate.

12. International visitors

MOMENTFORGE is based in the United States. If you access the website from another country, your information may be transferred to, stored in, and processed in the United States or other countries where our service providers operate. Where required, we use appropriate safeguards for cross-border transfers.

13. Third-party links

The website may link to websites or services operated by others, including social media platforms. Their privacy practices are governed by their own policies. We encourage you to review those policies before providing personal information.

14. Changes to this policy

We may update this policy to reflect changes in our practices, technology, or legal obligations. We will post the revised policy here, update the effective date, and provide additional notice when required by law. Material changes apply prospectively unless otherwise stated or permitted by law.
